UT Partnership LTC Insurance
UT is a non-functioning Long-Term Care Partnership state.
Following the provisions of the federal Deficit Reduction Act (DRA) passed by Congress in 2005, Utah's legislature expanded its Medicaid program to allow for qualified UT Partnership LTC insurance policies purchased after the state's effective date of October 1, 2014, to provide guaranteed Medicaid asset protection.
HOWEVER ... While the Utah Department of Health and Human Services developed its guidelines for how Partnership LTCI would interact with state Medicaid services, the Utah Department of Insurance never developed the required enabling regulations to permit insurance companies to offer Partnership-certified coverage in the state. Therefore, Medicaid asset protection, LTC insurance policies are NOT available for sale or purchase in Utah.
The Utah Long-Term Care Partnership Program was to be effective for policies issued after October 1, 2014, but again the state Partnership legislation was never implemented by the insurance commissioner through state regulations. Older policies were not grandfathered.
WARNING: Newer "linked-benefit" or "hybrid" LTC insurance benefits that are attached to a life insurance policy or an annuity do NOT ever qualify for Partnership asset protection in any state, even if the Hybrid LTC plan includes automatic inflation increases.
